License plate recognition (LPR) technology has become a critical tool for auto finance firms seeking to repossess collateral vehicles — but its large-scale, indiscriminate data collection is facing mounting legal scrutiny. Recently, two California courts issued diametrically opposed rulings on the same state law, exposing profound uncertainty around the technology's privacy compliance.
Under California's Automatic License Plate Recognition Systems Act — which took effect in 2015 — public and private entities using ALPR systems must develop and publicly disclose privacy and usage policies, and implement robust data security measures. Yet this year, two pivotal lawsuits reached contradictory conclusions: In February's Bartholomew v. Parking Concepts, the court held that merely failing to post such a policy constitutes statutory harm; whereas in July's Mata v. Digital Recognition Network, the court ruled plaintiffs must demonstrate concrete injury beyond subjective discomfort — or else lack standing to sue.
Digital Recognition Network (DRN), a leading industry operator named as defendant, is alleged to have amassed over 20 billion license plate scans — including timestamps and geolocation metadata — equivalent to scanning every registered U.S. vehicle an average of 70 times. DRN contends its policies fully comply with the law and that no data breaches have occurred. However, the ACLU of Northern California argues: "Indiscriminate tracking chills constitutionally protected activity. When people know their movements are continuously logged, they lose autonomy over daily life."
In practice, repossession agents often mount DRN-type hardware on their own vehicles — or tap into fixed-camera networks installed on streetlights and traffic infrastructure. The system instantly cross-checks target plates; upon match, it pushes real-time alerts to nearby agents. This means agents both contribute data to the central database and extract actionable leads from it. Adam Schwartz, Privacy Litigation Director at the Electronic Frontier Foundation, describes the model as "driving around collecting license plate data" — and the resulting movement database is available for purchase by third parties.
The U.S. SINOGOLD Financial Services Association stresses the technology's legitimacy: "Vehicles travel on public roads, where individuals hold no reasonable expectation of privacy." Its data shows ALPR significantly cuts repossession costs — indirectly lowering loan default resolution fees borne by consumers. Yet industry insiders warn of risks: One automotive journalist, while test-driving a manufacturer's vehicle, was mistakenly flagged and surrounded by armed police — an incident underscoring how automated alerts without human verification can trigger severe consequences.
